  1. HP OMEN Sponsorship (‘Sponsorship’) is a program that is conceptualized and organized by HP India Sales Pvt. Ltd. through its agent NODWIN Gaming Pvt. Ltd.(‘Organizers’). By submitting an application for the Entries, any person hereby agrees to these terms and conditions. The Organizers reserve the right to modify the Terms and Conditions of this Scholarship, without any prior notice and liability. HP and NODWIN Gaming Pvt Ltd may have access to the details shared by you.

  2. The Sponsorship is open for application to all Indian citizens residing in India, in the age group of 18 years to 23 years as on 31st March 2021 (hereinafter referred to as ‘Entries/ Entry’) except the employees of Organizers and their family members, Organizers’ associate companies, its distributors, its agents, its advertising and promotional agencies and its auditors and their associate companies.

  3. Entries will be invited from 25 March 2021 and will be open till 30 April 2021 (hereinafter referred to as the Sponsorship Invitation Period). The Organizers may in its absolute discretion curtail or extend the Sponsorship Invitation Period, as it deems necessary without any liability whatsoever; and no communication in this regard will be entertained.

  4. The Organizer may also in its absolute discretion alter the Scholarship Program and the allied details including but not limited to the number of slots available, the duration of the scholarships, the scholarship amounts, the minimum requirements for eligibility etc.

  5. The Organizer will at its sole discretion shortlist 3 applications from the Entries and the shortlisted applications (hereinafter referred to as (‘Winner’) will be provided with the Scholarships for a period of 1 year i.e from 1st July, 2021- 30th June, 2022 (hereinafter referred to as ‘Term’). Scholarships are limited in number, and subject to selection of upto 3 applications.

  6. Winners in receipt of Scholarship may also be required to sign an individual Scholarship agreement. Winners must meet all conditions as outlined in the agreement.

  7. The Winners offered scholarships will receive an official ‘offer’ email entailing the Scholarship Assistance and must reply either accepting or rejecting this offer within 14 days of receipt. Failure to respond within this 14-day period may result in the scholarship offer being withdrawn and reassigned. The Winner must accept the Scholarship offer by the due date, as instructed in the offer email, to be eligible to receive payment.

  8. The Organizers will provide the following assistance (hereinafter referred to as ‘Scholarship Assistance)’ to each Winner under the Scholarship-


    a. OMEN by HP equipment which will include an OMEN Laptop, headset, Mouse, mousepad, keyboard, monitor. This is hereinafter referred to as Equipment.

    b. One international trip for a period of 10 days to a esports training organized by a leading esports/ gaming company as per the sole discretion of the Organizer. Subject to travel documentations/ approvals.

    c. A financial aid upto INR 6,00,000/- for a period of one year for the Winner providing mutually agreed deliverables as will be provided in the Scholarship Agreement. The Organizer reserves the right to offer the funds in any manner as it deems fit. The financial aid can be paid into the Winner’s nominated bank account, or by other means, to be discussed between the Organizer and the Winner. The Organizer reserve the right to make final decision on how payment is made and can withdraw the offer of scholarship if an amicable and realistic payment process cannot be reached.

  9. The Organizer is not responsible for and cannot provide the Winner with financial advice on taxation matters.

  10. The Entries will be assessed on the basis of the eligibility criterion mentioned below –


    a. The Entry must have a valid gaming account with any game publisher of international repute.

    b. The Entry must have spent a minimum of 10,000 hours of playing the game of such publisher as mentioned above.

    c. An Entry must possess or shall have legal access to devices and facilities including but not limited to cameras, speakers, broadband routers, internet etc. that enables it to participate in this program. He/she shall also be connected to the internet at all times while submitting the required documents to the Organizers and participation in this Program

    d. The Entry must be solely responsible for sending any gaming video, gaming audio clips or virtual interviews as requested and specified by the Organizers during the course of the program as a part of the selection process.

  11. The Entry will be solely responsible to ensure all necessary software, hardware and internet requirements that can enable the Entry to be a part of the program. The Organizers will not be responsible for any issues regarding the internet connectivity, equipment or the software that may arise at the end of the Entry during the course of the program.

  12. Any travel that an Entry requires to undertake in order to be a part of the program, will need to be undertaken by the Entry at his/her own cost. The organizers will not bear any costs on account of the same. Under no circumstance will any such expense done by the Entry ensure shortlisting of the Entry to the next stage of the program by the Organizers.

  13. The Winner will be solely responsible for any expenses or costs that are over and above the Scholarship Assistance including but not limited to food, travel, boarding etc.

  14. The Winner agrees to become an OMEN ambassador and agrees to undertake activities agreed as reasonable and acceptable in general. This includes but does not limit to matters such as attending future recruitment events; answering enquiries of prospective entries; and contributing short articles and use of scholarship recipient’s images for newsletters and blogs. A description of the expected activities is given hereunder in Schedule A.

  15. The Winner will be responsible to provide the Organizer or any representative assigned by the Organizer with the details on how the Sponsorship Assistance is being spent by the Winner.

  16. The Organizer shall have the right to forfeit or rescind the Sponsorship from a Winner in any of the following cases-


    a. The Winner discontinuing the deliverables as mentioned in the Sponsorship Agreement.

    b. The Winner being found involved in any illegal activity including but not limited to hacking, substance abuse etc.

    c. If the Winner has provided incorrect, false or misleading information or withheld relevant information on the application or after receiving the Scholarship offer.

    d. The Winner indulging in any activity that may cause disrepute to the Organizers.

    e. The Winner is convicted of a criminal offence, or, in the Organizer’s opinion, is involved in any behavior or activities that could adversely affect the name or reputation of the Organizer or any of its affiliates, brand, products or events.

    f. If the Organizer determines that the Winner is or has been involved in any situation or occurrence that subjects the Winner to public scandal, disrepute, contempt, or ridicule, or which does or could be deemed by members of the general public to embarrass, offend, insult, or denigrate individuals or groups, or that will tend to shock, insult, or offend the community or public morals or decency, or would be reasonably likely to adversely impact the reputation of the Organizer, or Organizer’s products and brand.

  17. In the case where the Scholarship of any Winner is rescinded, the Winner will be liable to refund the entire Sponsorship amount that has been spent by the Organizer within 1 year of occurrence of such event.

  18. Scholarships will not be paid while Winners are on leave of absence or on temporary withdrawal from the program

  19. The Organizers will provide only the standard warranty for the Equipment which is prevalent as per the on-going market condition.

  20. It is the responsibility of the Winner to ensure that they are legally entitled to enter all aspects of this Scholarship.

  21. No purchase or consumption of Organizer’s products is necessary to participate in this Contest.

  22. The Organizers reserve the right to request the Winner to provide proof of identity and Indian residency at any time to validate the participation in this program. Identification considered suitable for verification is at the discretion of the Organizers.

  23. The Winner will be solely responsible to provide the Organizer with any valid document as requested by the Organizer including but not limited to PAN card, virtual Aadhar Card, bank account details etc. for the purpose of receiving the Scholarship Assistance.

  24. The Winner cannot change any detail submitted at the time of sending across their application for the Scholarship upon being shortlisted for the same.

  25. No queries/ clarifications/ suggestions/ communication etc. shall be entertained on operation/selection process, which would be entirely as per these Terms and Conditions or at the discretion of the Organizers.

  26. At the Organizer's request, the Entry must participate in all promotional activity (such as publicity and photography) surrounding the Scholarship, free of charge, and they consent to the Organizers using their name, likeness, image and/or voice and/or video footage (including photograph, film and/or recording of the same) in promotional material or in any media including but not limited to print media, social media, Organizer website, hoardings etc. for an unlimited period without remuneration for the purpose of promoting this Scholarship, through itself or its authorised third parties (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Organizers. The Entry also waives the right to inspect or approve the finished product, the advertising copy or other matter that may be used in connection therewith or the use to which is may be applied.

  27. The Organizer may also provide media with details of the Entries at any time as per the sole discretion of the Organizers. With reference to the above, the Entry grants permission to use, reproduce, distribute, communicate to the public, publish, publicly display, modify, translate, adapt, upload, download in any form or manner and / or permission to incorporate this material into other materials or works in any format or medium for any purpose and the right to sublicense those rights for any purpose.

  28. By participating in this program the Entry agrees to waive, release, and discharge the Organizer, its officers, associates, representatives and partner organisations from any and all liability, including but not limited to, any liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may occur to the Winner during or after the Term, including during or after any travel undertaken as part of the Scholarship.

  29. If the Entry is found using an unscrupulous or dishonest means of participating in the Scholarship program, or conducting in a manner detrimental to the spirit of the program, such Entry shall be immediately disqualified by the Organizers, in addition to undertaking other remedies available to the Organizers in law.

  30. Cash component of Sponsorship Assistance would be transferred to the bank account of the respective Winner post completion of the process applicable to payments made by the Organizer in the normal course of business like generation of PO etc. It is hereby clarified that the payment terms of the Scholarship Assistance will be at the sole discretion of the Organizers.

  31. Under no circumstance will any Winner or Entry be allowed to use any intellectual property of the Organizer including but not limited to the logo, for any purpose whatsoever, unless approved by the Organizer is writing

  32. If for any reason the Scholarship is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Organizers which corrupt or affect the administration, security, fairness, integrity or proper conduct of this program, the Organizers reserve the right (subject to any written directions given under applicable law) to disqualify any Entry and/or to cancel, terminate, modify or suspend the program.

  33. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Organizers and which prevents the Organizers from complying with these Terms and Conditions, the Organizers will not be liable for any failure to perform or delay in performing its obligation.

  34. The Scholarship Assistance is personal to the Winner and is not transferrable and cannot be sold under any circumstances. The Winner cannot sell the Equipment to any third party under any circumstance. In the case where the Organizer becomes aware of occurrence of such an event, the Winner will be liable to refund the entire or a part of the entire Sponsorship Assistance to the Organizer as per the Organizer’s sole discretion.

  35. If any provision of these Terms and Conditions is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Terms and Conditions and the remainder of the affected provisions shall continue to be valid.

  36. Organizers shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.

  37. All disputes relating to this Contest shall be subject to the exclusive jurisdiction of Courts at Gurgaon only.

  38. The Winner/ Entry will comply with these Terms and Conditions and waives any right to claim ambiguity in these Terms and Conditions.
